One tanker was bunkering after cargo discharge. Chief Officer went to sleep after cargo discharge whereas the ship was bunkering and ballasting was going on.

As chief officer was sleeping, he could not attend ballasting operation, which caused ballast tank to over flow during bunkering. Hence water over flowing from main deck to O’ board. If there was a bunker leak / spill was at the same time, it would have resulted in pollution - this is a case of fatigue.
